Heard while watching Fox News Sunday: Chris Wallace was interviewing Ted Olson about Prop 8 being overturned and was going on about the whole "activist judges" thing. Ted Olson at one point begins saying that it's only considered judicial activism if you disagree with their ruling (around the 6:20 mark in the video), and Chris interrupts with an emphatic "Exactly."
So, is Chris agreeing that the only reason that judge is being called activist is because his critics didn't agree with his ruling? Was he just not listening and got his talking points mixed up? Was Ted's rational and clearly stated defense of the ruling too overwhelming, shorting out the Fox News groupthink circuitry in Chris' brain? I was left in a state of confusion thinking that me and Chris were in agreement on this issue.
